Participation in this promotion is deemed acceptance of these terms and conditions and all valid entries must comply with these terms and conditions.

By entering the “Win a broadband & phone plan, free for a year” (“the Promotion”) you are agreeing to the following terms and conditions:

1.1 Information on how to enter the Promotion forms part of these Terms and Conditions.

2. who is eligible?

2.1 Entry is open to Perth, Sydney, Melbourne, Brisbane and Adelaide customers over 18 years of age who sign up online to an eligible 12 or 24 month fixed term broadband & phone plan between 1 June, 2011 to 30 June, 2011.

2.2 Staff from Seven Group Holdings Limited, West Australian Newspapers Limited and vividwireless Pty Ltd, and their associated agencies and companies are ineligible to enter.

3. how to enter

3.1 The Promotion commences on Monday 1st June 2011, at 9.00am (WST) and concludes at midnight (WST) on 30 June, 2011 (“the Promotion Period”).

3.2 To enter and be eligible to win the Promotion all entrants must:

a)       sign up to an eligible 12 month or 24 month broadband & phone plan. The $39 broadband & phone plan is excluded from this Promotion;

b)       acknowledge and accept that the Promoter reserves the right, at any time, to verify the validity of entries and entrants and to disqualify any entrant who submits an entry that is not in accordance with these Terms and Conditions or who tampers with the entry process. Failure by the Promoter to enforce any of its rights at any stage does not constitute a waiver of those rights;

c)       be 18 years of age or above;

d)   be a resident of Perth, Sydney, Melbourne, Brisbane or Adelaide living within the vividwireless coverage area. To check coverage go to http://www.vividwireless.com.au/how-to-buy/locations. Like all wireless networks,

many environmental and structural factors can affect signal strength such as buildings, trees, unusual terrain and distance from a base station; and

e)   not cancel their plan in accordance with the Money Back Guarantee.

4. prizes

4.1 There will be one winner selected at random. The winner will receive the prize package matching their chosen broadband & phone plan:

*Cost excludes phone calls(other than those included in your chosen broadband & phone plan).

4.2 The value of the prize package is the total of which plan you have chosen (includes device costs & $10 delivery cost) excluding phone calls*. The prize value is correct as at the date of publishing. The Promoter accepts no responsibility for any change in the prize value between now and the date upon which the Prize is accepted.

4.3 Entrants accept that vividwireless devices and vividwireless wireless broadband services operate only when located within the vividwireless coverage area...

4.4 The winner and anyone else utilizing the Prize will be responsible for all other expenses. No other expenses will be paid by the Promoter.

4.5 In accepting the Prize, the winner agrees to participate and co-operate as required in all editorial activities relating to the Promotion, including but not limited to being interviewed and photographed. The winner agrees to grant the Promoter a perpetual and exclusive licence to use such footage and photographs in all media worldwide and the winner will not be entitled to any fee for such use.

4.6 The winner agrees they will not sell or otherwise provide their story and/or photographs relating to the Promotion to any other media or similar organization without the prior written approval of the Promoter.

4.7 The Prize cannot be transferred nor redeemed for cash. Entrants should seek independent financial advice concerning any tax implications that may arise from the Prize.

4.8 The Prize may be subject to further conditions as determined by the Promoter and the winner must agree to these conditions upon accepting the Prize. The Promoter is responsible for the delivery and fulfilment of the Prize only. It is the entrant’s responsibility to access all other broadband & phone plan information from the vividwireless website.

5. selecting a winner

5.1 On 1^stJuly 2011, the Promoter will select at random an eligible entrant.. The Prize draw will take place at Suite 801, Level 8, 8 Central Avenue, Eveleigh NSW, 2015 at 9am (WST) on 1st July, 2011.

5.2 The winner will be contacted via phone and email within 5 working days of the Prize draw. vividwireless will refund the winner the cost of the device, delivery cost (if applicable) and broadband & phone plan costs incurred by the customer (other than excluded calls). vividwireless will reinstate the customer’s service at no charge for the remainder of the customer’s chosen fixed term contract period (i.e. 12 or 24 months). The prize does not include separate call costs. Subject to clause 5.3, if the winner cancels their account or receives the Money Back Guarantee, he/she will forfeit the Prize and will have no further claim whatsoever upon the Promoter.

5.3 The Promoter’s decision is final and the Promoter will not enter into correspondence regarding the result.

5.5 It is a condition of accepting the Prize that the winner must comply with all the terms and conditions of use of the Prize including but not limited to all device and broadband & phone plan terms and conditions.

6. no liability

6.1 In the case of any intervening act, agent, event or incident which prevents or significantly hinders the Promoters’ ability to proceed with the Promotion or the Prize on the dates and in the manner described in these terms and conditions, including but not limited to vandalism, power failures, tempests, natural disasters, acts of God, civil unrest, strike, war, act of terrorism, the Promoter may in its absolute discretion cancel the Promotion and may recommence it on an alternate date.

6.2 Seven Group Holdings Limited & its affiliates, West Australian Newspapers Limited and vividwireless Pty Ltd and their associated agencies and companies will take no responsibility for the Prize damaged or lost in transit, or late, lost or misdirected mail.

6.3 Seven Group Holdings Limited & its affiliates, West Australian Newspapers Limited and vividwireless Pty Ltd and their associated agencies and companies will not be liable for any misadventure, accident, injury, loss (including but not limited to consequential loss) or claim that may occur:

a) during the count in the Promotion Period;

b) whilst undertaking any travel connected with their entry into the Promotion;

c) as a consequence of late, lost or misdirected email;

e) due to the broadcast of any program relating to the Promotion or the publication of any material, including any statements made by any compeer, staff member, journalist, other entrants or any other person;

f) in relation to failure of an entry to be received by the Promoter on account of technical problems or traffic congestion; or

g) arising from or related to any problem or technical malfunction of any computer equipment, software, internet connection, any injury or damage to entrant's or any other person's computer software related to or resulting from participation in this Promotion.

6.4 The Promoter assumes no responsibility for any error, omission, interruption, deletion, defect, delay in operation or transmission, outage, communications line failure, theft or destruction or unauthorized access to, or alteration of, entries, and reserves the right to take any action that may be available.

6.5 If for any reason this Promotion is not capable of running as planned, including infection by computer virus, bugs, tampering, unauthorized intervention, fraud, technical failures or any other causes beyond the control of the Promoter which corrupt or affect the administration security, fairness, integrity or proper conduct of this Promotion, the Promoter reserves the right in its sole discretion to disqualify any individual who tampers with the entry process, take any action that may be available, and to cancel, terminate, modify or suspend the Promotion.
